Terms of Service

1. Introduction
These Terms of Service (the "Terms") govern your access to and use of the eSIM products, services, websites and applications (collectively, the "Service") provided by esimlocally, a trading name of Nad & S Co LLC ("esimlocally", "we", "us" or "our"). By purchasing, activating or otherwise using an esimlocally eSIM, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
2. The Service
esimlocally resells data-only eSIM plans powered by partner mobile network operators around the world. The Service provides mobile data connectivity only — it does not include voice calls, SMS, MMS, or a local phone number, unless explicitly stated on the product page at the time of purchase.
Coverage, supported networks, validity period and data allowance for each plan are described on the relevant product page and confirmed in your order confirmation email.
3. Eligibility & device compatibility
You are responsible for ensuring that your device is eSIM-compatible and carrier-unlocked before purchase. eSIM activations are delivered as a QR code or universal activation link by email after payment is confirmed.
Once installed on a device, an eSIM profile cannot be transferred to another device. We are not responsible for issues caused by incompatible, locked, jailbroken or modified devices.
4. Activation & validity
Unless otherwise stated, the validity period of your plan begins the moment data is first used in the destination country (first successful connection to a supported network). The plan expires automatically at the end of the validity period, regardless of any remaining data allowance.
Unused data does not roll over and is non-refundable once the plan has been activated.
5. Fair Usage Policy — "Unlimited" data plans
Plans marketed as "Unlimited" are subject to a Fair Usage Policy ("FUP") to protect network quality for all customers and to prevent abusive use of partner networks.
- The Fair Usage threshold for Unlimited plans is 20 GB per 30-day period, which reflects the average monthly data usage of a typical traveller.
- Once you exceed the 20 GB Fair Usage threshold, your connection speed may be reduced (typically to 384 Kbps – 512 Kbps) for the remainder of the plan's validity period, or until the plan is renewed.
- The Fair Usage threshold is calculated on data delivered to the primary device only and is monitored by the underlying network operator.
- Usage that is, in our reasonable judgement, fraudulent, automated, machine-to-machine, commercial in nature, or otherwise inconsistent with normal personal travel use, may result in immediate throttling, suspension or termination of the eSIM without refund.
6. Tethering & hotspot use
Tethering and personal hotspot use are NOT included in any esimlocally Unlimited plan. "Unlimited" data applies only to data consumed on the primary device into which the eSIM is installed.
- Any tethering, personal hotspot, Wi-Fi sharing, USB tethering or Bluetooth tethering does not count as Unlimited use and is not included in your allowance.
- Tethered traffic will reduce your data ability: it may be deprioritised, throttled, or counted against a much lower hidden cap set by the underlying network operator.
- Continued or excessive tethering may, at our or the operator's discretion, cause your data speeds to be reduced for the remainder of the plan, or your eSIM to be suspended without refund.
- For non-Unlimited (fixed allowance) plans, tethering is generally permitted within your purchased data allowance but is still subject to operator limits and may be restricted in certain destinations.
7. Prohibited use
You agree not to use the Service:
- For any unlawful, fraudulent, or abusive activity, including spamming, hacking, or distributing malware;
- To run servers, persistent peer-to-peer traffic, continuous video streaming for redistribution, crypto mining, or other machine-to-machine workloads;
- To resell, rent, or otherwise commercially exploit the Service without our prior written consent;
- In a way that violates the acceptable use policy of the underlying network operator or local law in the destination country.
8. Pricing, payment & taxes
All prices are shown in the currency indicated at checkout and are inclusive of applicable taxes unless stated otherwise. Payment is processed by our payment provider (Stripe). By submitting payment details, you authorise us to charge the full amount of your order.
9. Refunds
Because eSIM profiles are digital goods that are delivered immediately and tied to a single device, the following refund rules apply:
- Eligible for refund: The eSIM has not been installed on a device and you contact us within 30 days of purchase.
- Not eligible for refund: The eSIM has been installed, activated, or any data has been consumed; the plan has expired; the issue is caused by an incompatible or locked device; or the request relates to coverage in an area outside the advertised coverage map.
- Refunds for verified technical faults attributable to esimlocally or its partner networks are issued at our discretion, in whole or in part, after a support investigation.
10. Service availability & coverage
Mobile network coverage, speed and availability depend on the partner operator and local conditions in the destination country. We do not guarantee uninterrupted service, specific speeds, or coverage in any particular location, and we are not liable for outages, congestion or degradation originating from the underlying network.
11. Support
Customer support is available 24/7 via email at support@esimlocally.com or via the in-app chat on esimlocally.com. Most queries are resolved within 30 minutes.
12. Limitation of liability
To the maximum extent permitted by law, esimlocally's total aggregate liability arising out of or in connection with the Service is limited to the amount you paid for the eSIM plan giving rise to the claim. We are not liable for any indirect, consequential, incidental, special or punitive damages, including loss of profits, data, business or opportunity, even if advised of the possibility of such damages.
13. Privacy
Our handling of personal data is described in our Privacy Policy. By using the Service, you consent to such processing.
14. Changes to these Terms
We may update these Terms from time to time. The most current version will always be posted at esimlocally.com/terms. Material changes will be communicated by email or in-app notice where reasonably possible. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
15. Governing law
These Terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict-of-laws principles. Disputes shall be brought exclusively in the courts located in Sheridan County, Wyoming.
